REGULAMIN ŚWIADCZENIA USŁUG I REZERWACJI

of the website www.stativa.eu and STATIVA properties

§ 1. General Provisions

These Terms & Conditions define the rules for the provision of electronic services, as well as the rules for making reservations and staying at properties operated under the STATIVA brand by Valery Astrynski Stativa, ul. Piaskowa 54, 83-330 Skrzeszewo, NIP: 5842867222, REGON: 541494820, e-mail: office@stativa.eu (hereinafter referred to as the “Service Provider”).

These Terms & Conditions have been prepared in accordance with:
— the Act of 18 July 2002 on the Provision of Electronic Services;
— the Act of 30 May 2014 on Consumer Rights;
— the Act of 23 April 1964 — the Civil Code;
— the GDPR Regulation.

§ 2. Definitions

Service Provider / Lessor — Valery Astrynski Stativa, operating as a sole proprietorship.

Guest / Client — a natural person, legal person or organisational unit making a reservation.

Consumer — a natural person making a reservation not directly related to their business or professional activity.

Property — a holiday cabin (“chatka”) together with accompanying infrastructure, located in one of the STATIVA locations.

Reservation — a short-term rental agreement concluded between the Guest and the Service Provider.

Website — the website www.stativa.eu.

Booking Platform — an external service, such as Booking.com, Airbnb or Lodgify, through which a reservation may be made.

§ 3. Type and Scope of Services

The Service Provider provides the following services:

— short-term rental of holiday properties (cabins) together with infrastructure;
— additional services, such as access to a jacuzzi or breakfasts, as specified in the description of a given property;
— electronic services, including access to Website content, contact form, and “early access / newsletter” form.

Use of the Website is free of charge. Accommodation and additional services are subject to fees according to the price list valid on the reservation date.

§ 4. Technical Requirements

To use the Website properly, the following are required:

— a device with Internet access;
— an up-to-date web browser, such as Chrome, Firefox, Safari or Edge;
— an active e-mail account;
— enabled cookies for full functionality.

§ 5. Methods of Making a Reservation

A reservation may be made in one of the following ways:

5.1. Directly with the Service Provider

— via the contact form on the Website;
— by e-mail at office@stativa.eu;
— by phone at +48 500 874 889;
— through the Service Provider’s own booking system, if available.

5.2. Via Booking Platforms

Reservations may also be made via platforms such as Booking.com, Airbnb, Lodgify or other external systems. In such cases, the terms and policies of those platforms also apply, including their payment and cancellation rules, provided that they are not less favourable to the Consumer than these Terms & Conditions.

§ 6. Conclusion of the Agreement

The short-term rental agreement is concluded at the moment of:

— confirmation of the reservation by the Service Provider by e-mail, in the case of a direct reservation; or
— receipt of confirmation from the Booking Platform, in the case of a platform reservation.

The minimum reservation period is 2 nights. In exceptional cases, the Service Provider may accept a shorter reservation on individual terms.

§ 7. Prices and Payment Methods

Prices displayed on the Website and Booking Platforms are gross prices expressed in Polish zloty (PLN). The price includes the stay according to the property description and does not include additional services unless stated otherwise.

The Service Provider accepts the following payment methods:

— bank transfer to the account indicated in the reservation confirmation;
— online payment, such as BLIK or payment card, via a payment operator, if available;
— payment through a Booking Platform, such as Booking.com, Airbnb or Lodgify, according to the rules of that platform;
— cash or card payment on site, subject to prior agreement.

Payment models may include:

— full payment in advance;
— deposit / advance payment, e.g. 30%, with the remaining amount paid before or on the check-in date;
— full payment upon check-in, with reservation guaranteed by card details or individual agreement.

The specific payment model applicable to a given reservation is always indicated in the reservation confirmation or in the terms of the Booking Platform.

Invoice: upon the Guest’s request, the Service Provider issues a VAT-exempt invoice or an invoice without VAT, according to the applicable tax status, provided that invoice details are submitted no later than on the check-out date.

§ 8. Cancellation and Reservation Changes

Cancellation policy for direct reservations: the Service Provider applies a flexible cancellation policy. The Guest may cancel the reservation free of charge at any time before the start date of the stay. In the event of cancellation, all amounts paid, including deposits, advance payments and full payments, will be refunded in full within 14 business days to the account from which the payment was made.

Cancellation after the start of the stay: if the stay is shortened for reasons attributable to the Guest, the Service Provider will charge for the number of nights used, with the possibility of refunding any overpayment.

Reservations via external platforms: for reservations made via Booking.com, Airbnb or another platform, the cancellation rules selected for the given offer and specified by that platform apply. These Terms & Conditions apply only to the extent that they are not less favourable to the Consumer.

Cancellation by the Service Provider: in exceptional cases, such as force majeure or property failure, the Service Provider may cancel the reservation. In such a case, the Guest is entitled to a full refund of all amounts paid or to an alternative date / property.

Reservation change: changing the reservation date is possible free of charge, subject to property availability and agreement with the Service Provider.

§ 9. Right of Withdrawal from the Agreement

In accordance with Article 38 point 12 of the Act of 30 May 2014 on Consumer Rights, the Consumer does not have the right to withdraw from a distance contract concerning accommodation services other than for residential purposes, if the contract specifies the date or period of service provision.

Regardless of the above, the Service Provider applies the flexible cancellation policy described in § 8, which allows the Guest to cancel with a full refund.

§ 10. Check-in and Check-out

Check-in — from 15:00 on the first day of the stay, unless agreed otherwise.

Check-out — until 11:00 on the final day of the stay.

The Guest is required to present an identity document upon check-in.

The number of persons staying in the property may not exceed the number declared in the reservation.

§ 11. Guest Obligations

The Guest agrees to:

— use the property in accordance with its intended purpose;
— observe safety rules, especially regarding fire, jacuzzi, fireplace and other equipment;
— observe quiet hours from 22:00 to 7:00;
— refrain from smoking inside the property; smoking is allowed only in designated outdoor areas;
— avoid disturbing other Guests and residents;
— bring pets only after prior agreement with the Service Provider.

§ 12. Liability

The Guest bears full financial responsibility for damage caused to the property by the Guest or persons under the Guest’s care, including children and pets.

The Service Provider is not liable for:

— items left in the property after check-out;
— damage resulting from improper use of the property or its equipment;
— interruptions in utilities, such as electricity, water or Internet, caused by circumstances beyond the Service Provider’s control;
— force majeure events.

The Service Provider’s liability towards the Consumer is not limited to the extent prohibited by mandatory provisions of law.

§ 13. Complaints

The Guest has the right to submit a complaint regarding the services provided.

Complaints should be sent:

— by e-mail to office@stativa.eu;
— in writing to: ul. Piaskowa 54A, 83-330 Skrzeszewo Żukowskie, Poland.

The complaint should include the Guest’s details, a description of the situation, the date of the event and the expected method of resolution.

Complaints will be reviewed within 14 days of receipt. Lack of response within this period means that the complaint has been accepted.

§ 14. Out-of-Court Dispute Resolution

The Consumer may use out-of-court complaint and claim resolution methods, including:

— applying to a permanent consumer arbitration court;
— contacting the Provincial Inspectorate of Trade Inspection;
— using the European Commission ODR platform.

Use of out-of-court dispute resolution methods is voluntary.

§ 15. Provision of Electronic Services

Within the Website, the Service Provider provides the following electronic services:

— access to informational content;
— contact form;
— newsletter / early access sign-up;
— booking form, if available.

It is prohibited to provide unlawful content. The User is obliged not to submit content that is unlawful, infringes personal rights, copyrights or applicable law.

The User may stop using electronic services at any time by ceasing to use the Website or by contacting the Service Provider.

§ 16. Personal Data Protection

The rules for processing personal data are set out in the Privacy Policy, available in the Website footer, which forms an integral part of these Terms & Conditions.

§ 17. Final Provisions

Matters not regulated by these Terms & Conditions are governed by Polish law, in particular the Civil Code and the Act on Consumer Rights.

The court competent for disputes arising from an agreement concluded with a Consumer shall be the court determined according to general provisions of law.

For disputes with entrepreneurs, the competent court shall be the court having jurisdiction over the registered office of the Service Provider.

The Service Provider reserves the right to amend these Terms & Conditions. Changes enter into force upon publication of the new version on the Website. Reservations already concluded are governed by the Terms & Conditions in force at the time of conclusion.

These Terms & Conditions apply from: May 2026.

1. Contact Form (/contact)

Information clause:

The Controller of your personal data is Valery Astrynski Stativa, ul. Piaskowa 54, 83-330 Skrzeszewo, NIP 5842867222. Your data, including name, e-mail address and message content, will be processed only to respond to your inquiry, on the basis of Article 6(1)(b) and Article 6(1)(f) GDPR.

You have the right to access, rectify, erase or restrict the processing of your data, object to processing and lodge a complaint with the President of the Personal Data Protection Office. Full information can be found in our Privacy Policy.

Note: a separate consent checkbox is not required for the contact form. An information clause and a link to the Privacy Policy placed near the “Send” button are sufficient.

2. Newsletter / Early Access Form (/earlyaccess)

Checkbox 1 — marketing consent (REQUIRED)

Information clause:

You may withdraw your consent at any time by clicking the “unsubscribe” link in the footer of each message or by writing to office@stativa.eu, without affecting the lawfulness of processing before withdrawal.

You have the right to access, rectify, erase, restrict, transfer and object to the processing of your data, as well as to lodge a complaint with the President of the Personal Data Protection Office. Details are available in the Privacy Policy.

3. Booking Form, if implemented

Checkbox 1 — acceptance of Terms & Conditions (REQUIRED)

Checkbox 2 — marketing consent (OPTIONAL)

Information clause:

The Controller of the data is Valery Astrynski Stativa, NIP 5842867222. The data is processed for the purpose of concluding and performing the reservation agreement, issuing accounting documents and possible establishment, exercise or defence of legal claims.

Providing data is voluntary, but necessary to conclude the agreement. Full information, including rights and retention periods, can be found in the Privacy Policy.

We use cookies to ensure the proper functioning of the Website, analyse traffic and tailor marketing content. Necessary cookies are required for the Website to function. Other cookies are used only with your consent. You can accept all cookies, reject non-essential cookies or customise your preferences. Details are available in the Cookies Policy and Privacy Policy.

Required buttons:

— “Accept all” — acceptance of all cookie categories;
— “Reject all” — acceptance of necessary cookies only;
— “Customise” / “Settings” — detailed selection of categories, such as functional, analytical and marketing cookies.

6. Implementation Checklist

After publishing the documents, complete the following actions in the Wix panel:

— Create three subpages: /privacy-policy, /cookies-policy, /terms-and-conditions and paste the relevant content.

— Add links to these three pages and company data in the footer.

— Activate the cookie banner in Wix: Settings → Cookies & Privacy → Cookie Banner.

— Configure three buttons: Accept / Reject / Customise and paste the text from point 5.

— Add the information clause from point 1 under the contact form.

— Add the consent checkbox and clause from point 2 under the newsletter form.

— Configure Google Tag Manager with Consent Mode v2 — analytics and marketing tags should run only after consent is obtained.

— Check the consent withdrawal mechanism, for example via a “Cookie Settings” link in the footer.

— Test the full path: first visit → banner → rejection → no loading of GA and Google Ads in Network / DevTools.
